FELON IN POSSESSION OF FIREARM, FEDERAL COURT

Jury Verdict: NOT GUILTY
In a felon in possession of a firearm case in federal district court in St. Paul, my client, who had nine prior felonies, a fact known to the jury, was pulled over for rolling through a stop sign. He is Native American. He was driving a new minivan (a rental) in South Minneapolis near Franklin Avenue. Two juveniles were passengers. Minneapolis police found 6 live .357 caliber rounds in the driver’s door handle. Police found a loaded .357 revolver hidden in the console on the front passenger’s side of the van. The mandatory sentence was 30 years in prison. My client testified. After a three-day trial, a jury found my client not guilty of all charges on the second day of deliberations.

GANG FIGHT AT MALL, HENNEPIN COUNTY 
2004
Jury Verdict: NOT GUILTY
In a trial involving a fight between alleged gang members at a very large mall in Bloomington, an alleged gang member was stabbed in the head with a 10” screwdriver, which was shoved though his head, front-to-back. My client was in the midst of the scuffle. After a five-day trial and two days of jury deliberations, he was found not guilty of all charges.


PARENTAL ASSAULT OF CHILD, RAMSEY COUNTY
 2002
Jury Verdict: NOT GUILTY
A teenage daughter accused her father, my client, of severely beating her on a Saturday morning at breakfast. She was taken to the Emergency Room by my client’s live in girlfriend. Police photographed her injuries; bruises and cuts (with scabs over them). Child protective services and a police sergeant interviewed my client. Both the child protective services person and the police officer testified that my client confessed. The daughter testified. My client testified. The jury acquitted him of all charges. Several other girls her own age had beaten the daughter on the school bus on Friday afternoon.

Jury Verdict: NOT GUILTY
My client was caught driving a car with a handgun under the driver’s seat. He was found not guilty by a jury.

POSSESSION OF HANDGUN BY FELON, RAMSEY COUNTY 2000
EVIDENCE SUPPRESSED, CASE DISMISSED
Police with search warrant failed to knock and announce. They seized handgun. We moved to suppress for illegal search and seizure. Judge agreed and suppressed the evidence. Case dismissed.

SHOOTING/SECOND DEGREE ASSAULT, RAMSEY COUNTY 1996
CASE DISMISSED
My client was accused of chasing a man down a city street as he fired a gun at the man. The prosecutor dismissed the case.

DOMESTIC ASSAULT, DAKOTA COUNTY 1999
CASE DISMISSED
My client was accused of beating up her husband. We refused all offers to settle and the prosecutor dismissed on the day of trial.

POSSESSION OF STOLEN PROPERTY, RAMSEY COUNTY 2000

My client was accused of possessing a substantial amount of stolen goods. Prosecutor dismissed.

COUNTERFEITING U.S. CURRENCY, CHISAGO COUNTY 2008

Counterfeiting case dismissed.

FIRST-DEGREE BURGLARY, HENNEPIN COUNTY 2010
CASE DISMISSED
My client was accused of five counts of first-degree burglary. Case was dismissed by the prosecutor after the defense investigation revealed a lack of evidence.

LURKING, HENNEPIN COUNTY 2010
CASE DISMISSED
My client was charged with “lurking with intent.” We refused to plead and the prosecutor dismissed.
